Details you share to utilize our services:
a. Personal Details: This can comprise your full name, mailing address, contact numbers, email id, birthdate, and national identifiers you provide during registration to meet the SEC standardized KYC requirements.
b. Monetary Details: This encompasses details related to your bank, transaction records, account types and their restrictions, names of your financial institutions, and other relevant financial data we gather from you or your bank.
c. Nominee Details: If you register for an account type that requires or allows a nominee or beneficiary, we may ask for their relevant details.
When you open an account, Ghanaian law requires us to verify your identity biometrically against the National Identification Authority (NIA) database. To do this, we ask you to take a photograph of your face (a "selfie") using your device camera, together with your Ghana Card number.
a. What we collect: A single photograph of your face. We do not create, derive or store a face template, faceprint or any other mathematical representation of your face, and we do not use facial recognition to identify you in any other context.
b. Why we collect it: Solely to confirm that you are the rightful holder of the Ghana Card number you provide. This is required under the Anti-Money Laundering Act, 2020 (Act 1044), the Securities and Exchange Commission's AML/CFT/CPF Guidelines, and Ghana's national identity regulations, which as of 16 July 2026 make biometric verification the only lawful means of verifying a Ghana Card holder's identity.
c. Who we share it with: Your photograph is transmitted securely to the National Identification Authority of Ghana for the sole purpose of this identity check. We do not share it with any other third party, and we never use it for advertising, marketing, profiling or analytics.
d. How long we keep it: Five years after the end of your business relationship with us, as required by the Anti-Money Laundering Act, 2020 (Act 1044) and SEC record-keeping obligations. It is securely deleted at the end of that period.
e. Your choices: Identity verification is a legal precondition to opening an account, so we cannot offer an account without it. You control when the photograph is taken, and you may review, delete and retake it before submitting.
a. Service Provision: Your details aid us in offering you our services, processing your transactions, verifying your identity, and ensuring you receive optimum user experience.
b. Communication: We may use your contact details to send you important notices, updates, or promotional material. You have the right to opt-out of any promotional communications.
c. Legal Obligations: We might be required to disclose your details when mandated by law, or to adhere to our regulatory requirements.
d. Improvements & Research: To enhance our application, we may utilize anonymized data for research and analysis, ensuring better services for our users.
e. Protection: We use your data to protect our application, our users, and Black Star Group from fraud, illegal activities, and other potential threats.
We value your privacy and will not sell your personal data to third parties. However, we may share your data with:
a. Affiliates: Such as Black Star Brokerage Ltd. and Black Star Advisors Ltd. for the provision of integrated services.
b. Service Providers: Entities such as banks, FinTech's, etc. that assist us in our business operations. They are bound by contractual obligations to keep personal information confidential and use it only for the purposes we specify.
c. Legal Reasons: If required by law, regulation, or in the good faith belief that such action is necessary to conform with legal requirements.
d. National Identification Authority (NIA): Where we are required to verify your identity biometrically, we share your identity verification photograph and Ghana Card number with Ghana's National Identification Authority solely for that verification.
We implement a variety of security measures to ensure the safety of your personal information. These measures include encryption, secure servers, and regular security audits.
a. Advanced Encryption: All sensitive data, such as your financial details and transaction records, are encrypted using state-of-the-art encryption techniques.
b. Two-Factor Authentication (2FA): For added security, we offer 2FA for user accounts. This provides an extra layer of protection against unauthorized access.
c. Limitation to Client Data: We store personal information electronically on cloud servers to which only authorized persons have access, and only by means of secure passwords. We authorize employees and service providers to have access to clients' personal information only on a "need-to-know" basis to fulfill their job requirements.
d. Incident Response: In the unlikely event of a security breach, we have a rapid response team ready to address and mitigate any potential risks. Our users will be promptly notified of any such incidents that might affect their data.
We keep your personal data only as long as necessary for the purposes described in this policy, or as required by law. As a market operator licensed by the Securities and Exchange Commission of Ghana, we are required to retain customer identification and due-diligence records, including identity verification records and biometric information collected under section 4.1, for at least five years after the end of your business relationship with us, under the Anti-Money Laundering Act, 2020 (Act 1044). Records may also be retained for the period required for SEC inspections. After the applicable period expires, we securely delete or anonymise the data.
You have the right to access, update, and correct personal data in Black Star's custody and control, but some legal limits may apply. You may update certain profile information you have provided to us by, you may send a written request to this effect to clientservices@blackstargroup.ai. We may request certain personal information for the purposes of verifying your identity.
You may also request deletion of your personal data. Please note that we are legally required to retain certain records, in particular identification and due-diligence records under the Anti-Money Laundering Act, 2020 (Act 1044) and SEC record-keeping obligations. Where that applies, we must keep that data for the required retention period and cannot delete it earlier. We will delete it once that obligation expires.
The Black Star Group mobile application and website may use cookies and other tracking mechanisms to improve user experience and gather data about usage patterns.
From time to time, we may send you email, SMS text messages and other communications about Black Star's products, services, or events that may be of interest to you. You can opt-out of receiving marketing and promotional email from us by following the unsubscribe instructions contained in each of our email communications. Please note that you will continue to receive email regarding your account and transactions with us. Alternatively, you can unsubscribe from any of our marketing communications by contacting us at clientservices@blackstargroup.ai.
